Evaluative concepts in judgments of the European Court of Human Rights in the sphere of penal jurisdiction
The article examines the use of evaluative concepts in activity of the European Court of Human Rights in relation to thestatus of a person in prison. Some evaluative concepts contained in the European Convention for theProtection of Human Rights and Fundamental Freedoms 1960 are under consideration. Summarizingexperience of judgments of the European Court of Human Rights and complaints made against them,the author concludes that application of precedents in the Court is greatly complicated by the lack of anorganized and clearly defined approach to the disclosure of each concrete evaluative concept. Differentways of developing the problem of evaluative concepts in European supranational law are examined inthe present article.
