Fate of a dower in the community property
The article deals with the analysis of both legal literature and court practice in relation to the dower in the community property which under probate is converted into the joint shared ownership of the widow (widower) and lawful heirs. It is stated that provision i.33 of the Ruling of the Russian Federation Supreme Court Plenum 29.05.2012 is inconsistent with current legislation and shall be altered.
