The first experience in using the post penitentiary administrative supervision
The article deals with some problems of practical infliction of post penitentiary supervision taking into account the first experience in its application and the Ruling of the Plenum of the Supreme Court of the Russian Federation. The author has analyzed 200 identification records of released convicts who were placed under administrative supervision in the Ivanovo region in 2011-2013 and produced the portrait of a statistically average supervised person: a male (94%) who was released from prison at the age of 30-39 (41%).Supervised people of other ages constitute a less part: at the age of 25-29 (22%), 40-49 (18%), 20-24 (7%), 50-54 (6%), 55-59 (5%) and 18-19 (1%). Those who were 30-39 and 25-29 at the moment of commission of the crime constitute 26% and 25% respectively. Supervised people of other ages constitute a lesser part: at the age of 20-24(19, 5%), 40-49 (15, 5%), under 18 (5%), 18-19 (5%), 50-54(3%) and 55-59 (1%). 62% of supervised people committed crimes during a year and 10 months after their release from prison. The grounds for release of supervised people from prisons were: completion of sentences (89%), conditional release (10%) and substitution of punishment (1%). The structure of crimes committed by supervised people looks like this: 60% of all the crimes they were last punished for cover stealing i.e. thefts constitute 33%, robberies -17% and plunders-8%. Crimes against life and health constitute 18%. 8% of supervised population served their sentences for intended grievous bodily harm (72% of whom were convicted under Part 4,Article 111of the Criminal Code of the Russian Federation), 5%- for murder. Crimes against sexual freedom and sexual immunity constitute 10% including rapes (4%), sexual battery (5%) and sexual abuse (1%). Stealing constitutes the largest part in the structure of crimes committed by the supervised people before they had served their latest sentence-69%. Thefts constitute over a half of all crimes-52%, rob-beries-4%, plunders-4% frauds-0, 8%, appropriations and embezzlements-0, 5%.The share of crimes against life and health is rather small- only 5,2%. 0, 5% of supervised people earlier committed murders and 2%- inflicted intended grievous bodily harm. Only 1, 1% of the supervised people were sentenced before their latest conviction for crimes against sexual freedom and sexual immunity. 7% of people under administrative supervision had committed repeated crimes by the beginning of this research and stealing (thefts and robberies) constitute more than half of all crimes.
