On the effectiveness of the Commissions on Juveniles Affairs and Protection of their Rights

The timeliness and effectiveness of the preventers' activities at early stages of prevention is very important. Under current federal legislation, the Commissions on Juveniles Affairs and Protection of their Rights head the system of prevention of juvenile neglect and delinquency. The Commissions are often considered to be a liaison between the system of delinquency prevention and the system of administration of juvenile justice. The effectiveness of Commissions is essentially different and depends on the subjects of the Russian Federation. Some researchers stress that the problems of normative legal regulation of the Commissions activities have not been solved yet. The lack of a universal state approach decreases the quality and effectiveness of both the Commissions and the whole prevention system and it results in the impossibility to ensure the interests of juveniles and direct violation of their rights and legal interests. The regulation of the activities of the Commissions on Juveniles Affairs and Protection of their Rights in 2012-2013 was considerably corrected. Federal legislators stressed the significance of the coordinative function of the Commissions within the system of prevention of juvenile neglect and delinquency. The Ruling № 995 of the Government of the Russian Federation dated 06.11.2013 approved the Draft Provision on the Commissions on Juveniles Affairs and Protection of their Rights. But the approval did not eliminate all the questions relating to the regulation of the Commissions activities. The author of the article thinks that federal compulsory requirements are necessary, though, regional specificity is also significant. Thus, to raise the effectiveness of the Commissions and to unify the law enforcement practice, there should be a Federal law on the Commissions including the normative standards for staffing.
