Principles of social security law: shortly before the codification

The article deals with the problems of codification in the social security sphere. Having analyzed the normative acts and special literature, the author proposes some wordings of the principles of social security law into the Social Code of the Russian Federation: the principle of accounting the objective criteria when differentiating social security (the principle of fair differentiation of social security), the principle of matching social payments to the type of need, the principle prohibiting the employer to fund social payments beyond insurance premiums. The author briefly covers the problems of codification in social security. She argues that the establishment of a privileged system of pension security of judges and some state officials violates the constitutional principle of equality of citizens' rights i.e. working people are discriminated on the basis of their official position. The nature of payments made by state authorities in connection with mass loss of life in the situations that are not caused by technogenic, natural factors or antiterrorist events e.g. payments to the families of dead in the Perm club "A lame horse" has been analyzed. The rules of social security law that are inconsistent with the Constitution of the Russian Federation are under consideration. It has been substantiated that an employer should not make any social payments to his/her workers unless he/she is voluntarily bound to do this within the framework of social partnership.
