Establishment and development of the legal doctrine of inter-municipal cooperation in Russia
The article examines the establishment and development of the legal doctrine of inter-municipal cooperation in Russia starting from its complete abolishment in the Soviet period up to the renaissance and active pursuance in post-Soviet time. Thus, it is interesting to trace the evolution of views on inter-municipal cooperation starting from the origin of the inter-municipal movement, its development up to the formation of modern doctrine and elaboration of the organizational legal forms for its coordination. The development of inter-municipal cooperation can be divided into three periods: a pre-revolutionary period (1862-1917), Soviet period (1917-1991) and a modern one. The inter-municipal cooperation in Russia dates back to the Zemstvo reform (1864) and Town reform (1874) which were aimed at the decentralization of administration and support of independence of local bodies in Russia. The establishment of the Soviet regime in 1917 and the historical period up to 1990 was characterized by the abolition of zemsky and town self-government and its substitution by the system of local councils of people's deputies, executive committees which exercised their powers under the administrative control of party organs. However, despite a strict hierarchy in state apparatus there was an informal and limited interaction between local soviet authorities. It was the cooperation with local organizations, exchange of opinion in the sphere of administration, assistance in decision-making, meetings of leaders, consultations etc. The reactivation of local government in Russia in the 90s of the 20 century resulted in the demand for inter-municipal cooperation. The independence of local bodies gave rise to the uniting attitude towards the solution of common problems in municipal economy. The specialists in local government state that search for cooperation is neither artificial and nor imposed by the authorities. It appeared due to the understanding by the municipal bodies of the objective need to unite, pursuing two purposes: an economic and a political one (sharing a municipal government experience and advocating the interests of territorial communities of different levels). The Federal law № 131-FZ "On General Principles of the Organization of Local Self-Government in the Russian Federation" of 06.10.2003 has considerably broadened the possibilities for the local bodies' participation (especially in institutional form) in inter-municipal cooperation. Municipalities realize this right through the municipal councils, municipal organizations (inter-regional associations and unions), inter-municipal economic societies, non-commercial organizations, inter-municipal contracts and agreements.
