Goals and tasks of social security law in Russia

Being a hypothetic category in law, goal is a remote in time and a would-be phenomenon or event to be achieved by help of all legal instruments. Tasks have a more modest mission, they specify goals; they help to endorse and clarify directions and ways (means) for achieving the goals of legal regulation. Goals are set and achieved; tasks are also set but unlike goals are solved in the course of legal activities. Thus, we can state that goals and tasks are correlated as the general and the particular. Tasks should not contradict the goals since their conflict results in instability of legal mechanism, in non-realization of legal prescriptions. The goal of social security legislation is to secure the right to state maintenance for those welfare The norms of social security law are realized in the form of law enforcement. Therefore, the achievement of goals and tasks of social security law depends on the quality of law enforcement and they are aimed at observing the provisions of legal norms precisely and consistently. Moreover, free choice of behavior options of all participants involved in law enforcement is ultimately limited and this concerns both the bodies and organizations which are obliged to assist and maintain and the people in need. While analyzing the tasks of social security legislation and law taken as a whole, we proceed from the fact that unlike the goals they are not considered to be general sectoral categories. These tasks are dispersed in two directions: 1) according to the form of organization and functioning of social security: a) an insurable form; b) a budgetary form; 2) according to separate kinds of security. In its turn, the tasks of different types of social security are grouped according to its twin goal. A basic group includes the kinds designated to help those in need, the second group contains the provisions of social security designated to support these categories of subjects of law. It is worth noting that legislation set the common tasks both for insurable and budgetary ways of social security.
