About the application of the civil legislation in regulation of labour relations
The application of civil law to labour relations is a necessary reality in modern conditions. Analysis of legal acts and doctrinal sources allows to make a conclusion about the necessity of civil law regulation of labour relations in order to provide additional opportunities to employees in the implementation and protection of their rights. The article explores some practical related law situations that can be resolved on the basis of subsidiary application of civil law. This is possible in relation to the liability of the employer for delay of payment of wages, unjust enrichment in employment relations and others. Special attention is given to the preparation of the employment contract and the agreement of individual conditions based on the subsidiary application of civil law. The article presents analysis of judicial practice of the studied issues.
