Open source data in the mechanism for implementing the right of citizens to true information about the environmental conditions
The article deals with the current state and prospects for improving legal mechanism for implementation of the right of citizens to information about environmental conditions in the light of development of the open data institute. The research was done on the basis of methodology of a system approach with the use of vertical and horizontal methods in comparative law research. Modern tendencies in the development of the mechanism for implementing the right of citizens to reliable information about environmental conditions are examined on the basis of the analysis of international legal acts (The Aarhus convention, the Charter of open data of the Group of eight) and legislation of Germany. The general tendency towards increasing the level of openness of public authorities and local governments is traced. Specificity of ecological information is revealed since not only information on activity of public authorities, but information about environmental conditions available for public authorities in considerable volumes is of serious public interest. The results of the examination of Russian legislation and subordinate normative legal acts stress the need to fix the obligation of public authorities to publish the information on environmental conditions in a format of open data in the Internet. Such an obligation shall be entrenched in legislation.
