Online arbitration as means for adjudication of cross-border economic disputes. Problems of compulsory execution of online arbitral awards

The authors of the given article analyze online-arbitration as a modern developing way for adjudicating cross-border economic disputes. The term "online arbitration" is used for the description of arbitration trial conducted with the use of technologies of distance communication between trial participants. Some advantages of online adjudication are noted. At the same time, it is emphasized that placement of arbitration under an online mode can create certain difficulties for the realization of the mechanism of compulsory execution of arbitral awards. The authors showed interest in three groups of reasons, which complicate the dynamic development of arbitration procedure of legal conflicts in the electronic information environment. The first group of legal obstacles concerns the arbitration agreement, the second one has a procedural character, and, at last, the third group of obstacles for online arbitration is connected with the final decision. Unresolved problems threaten the prospect for wide spread online arbitration in practice. There is a need to create standard regulation, which would provide a possibility for compulsory execution of online arbitral awards. This will be possible, firstly, when each state passes the legislation on the use of electronic documents and digital signature. In this case, the electronic form of arbitration agreement and arbitral award can be equated to a written one. Secondly, when resolving an issue of compulsory execution of the decisions passed by arbitration online, courts have to interpret provisions of the New York Convention 1958 leniently, proceeding from the "functional approach", taking into account autonomy of the will of the parties, which concluded the agreement on online arbitration. At the same time, much attention should be paid to special aspects of communicating via distant means. Thirdly, we need a special act, may be of advisory nature, of online regulating the adjudication of cross-border disputes which would become a reference point both for arbitrators (judges), and for administrators of online arbitration platforms for the creation of regulations.
