Policy of double standards in Russian pension rights and legislation
The article examines the policy of double standards in the Russian pension law and legislation, i.e. a double approach to the provision of pensions to various categories of citizens, the existence of insurance and state pension, which differ significantly in terms of the conditions of appointment and the size of pensions. The article examines the legal regulation of pension provision for different categories of citizens insurance and the state pensionireformi in the Russian Federation. The author defined the reasons of origin of a dual approach to pension provision for different categories of citizens, a comparative analysis of a number of Federal laws regulating insurance and state pension provision, significant differences in terms of destination and pensions to various categories of citizens. In result of the conducted research the conclusion about the existence of a policy of double standards in the national pension law and legislation, i.e. a dual approach to pension provision for different categories of citizens, the presence of insurance and government pension that vary greatly in terms of purpose and size of pensions, identified shortcomings and implications of this policy. There are also quite serious error in the first place, the text of the law on insurance pensions: gaps, among the most important of which is the lack of special article stating the list of subjects of pension relations, their status rights and obligations; name of the individual sections and articles not relevant to the content. To correct the imbalance in the pension system it is proposed to establish a uniform, standardised rules for calculating the sizes of both state and insurance pensions. A legislative solution to this problem is possible through drastic changes in the content of Chapter 4 of the Law on insurance pensions, through the adoption of common, consolidated regulatory act (Federal law) entitled "On pension provision in the Russian Federation".
