Behavior (activity) of those incidentally involved in a criminal event as a crime mechanism element: from articulation of a scientific problem to the results of research
The target of research in the given article is the phenomena, processes and situations of a pre criminal, criminal and post-criminal reality caused by behavior of those incidentally involved in a criminal event and connected both with criminal activity and with the activities on the disclosure and investigation of crimes. The purpose of the article is the detection of earlier unstudied regularities of behavior of those incidentally involved in a criminal event (criminal and post-criminal periods). When researching the above hypothesis, the author applied the following tools of a system criminalistic knowledge: a) according to a specially developed questionnaire he examined 127 video episodes of heinous grievous violent crimes (fixed by CCTVs, video recorders, mobile phones, unmanned aerial vehicles [5], [6], [7] and other means of fixation); b) 500 citizens of the Southern Federal District of Russia involved in a criminal event as the injured party and/or the eyewitness were interviewed; c) 73 subjects of investigation of crimes who arrived to the place of an event of crime were interviewed and d) 100 criminal cases on grievous mercenary and violent crimes. In our opinion, the construction of such tools of knowledge enables the scientist-criminalist to examine fully and in details the events of both criminal and post-criminal character in relation to the majority of urgent problems of the theory and practice of criminalistics [8]. The author used the following approaches to getting knowledge about the objects of a criminalistic research and regularities of the behavior of persons under study: an activity [9]approach , situational [10], system [11] and synergetic ones. Theoretical importance of the research is that the author defines the fundamental problem of the need to obtain new criminalistic knowledge, when examining the regularities of behavior (activity) of those incidentally involved (either actively or inactively) in a criminal event in the context of grievous violent crimes on the basis of generalization and the analysis of achievements in the field of criminalistics. It seems that new systems of knowledge and theoretical provisions are intended to add and develop criminalistics to a significant degree. Practical importance of the research is determined by the general tendency to enrich the knowledge about current fight against grievous violent crimes by the improvement of legal, organizational, methodical and tactical bases for the activities of functionally determined subjects for disclosure and investigation of these crimes, including the influence and control of the above type of human behavior in terms of criminalistic activity.
