Legal obligation through the prism of the theoretical-legal analysis of the provisions of the Constitution of the Russian Federation

The article studies the legal responsibilities as an integral element of the legal status of the individual. All enshrined in normative legal acts correspond to the duties of the appropriate authority. Currently, in the legal literature there is no uniform approach regarding the notion of "legal obligation" under which the authors refers to an unconditional categorical (power imperative is to follow a prescribed behavior), provided measures of state coercion. Legal duties enshrined in the Constitution of the Russian Federation, has the following characteristics: the exemption from the duty, as well as its establishment, is possible only on the basis of the law; duty may be imposed on all persons etc. There is a need to allocate a large number of criteria for the classification of legal responsibilities. In particular, allocate the responsibilities of man and citizen, active and passive, public, social, personal, etc. Analysis of the correlation of rights and duties enshrined in the Basic laws of the various States, allows to make a conclusion about its unevenness. Recently in the world there is a trend to expand the hidden constitutional duties, i.e. the duties arising from the content of the norms of the basic law, but there are not directly formulated. Today, the Russian Constitution provides for the following duties: preservation of nature and environment, protection of the Fatherland, protection of designated historic and cultural heritage and monuments of history and culture, the obligation to pay legally established taxes and fees, the obligation to receive basic General education. The conducted research allowed to formulate the following conclusions: without notation in the heading of Chapter II of the Constitution of the Russian Federation, the main responsibilities of the individual found in it the reflection and consolidation; by applying the methodology of basic science of theory of state and law detects the presence in the basic law of the Russian state a significant amount of hidden responsibilities. It is possible to ascertain the absence of direct fixing of the duties of the state to the person; legal status of the individual is the unity and interrelation of rights and duties, hence the name of the second Chapter of the Constitution of the Russian Federation requires clarification, as the list and content of the duty of the state to the individual and society.
