About the principle of implementation of town-planning activity with compliance with the requirements of preservation of cultural heritage and specially protected natural areas and the mechanism of its implementation
In article one of the key interindustry principles of the modern town-planning legislation is investigated. Importance of its consideration is that it allows to look in a new way at dynamics of interindustry communications which is insufficiently in detail studied in relation to the town-planning legislation unlike many other branches of the right, for example, of civil law. Considering this principle in the context of the main institutes of the town-planning right, the author shows the mechanism of accounting of requirements for protection of cultural heritage and OOPT by preparation of all types of town-planning documentation, including documents of territorial planning and town-planning zoning. In article existence of a problem of account in town-planning documentation of special legal status of the objects of natural heritage which are not a part of OOPT is noted. GRK Russian Federation repeatedly mentions objects of cultural heritage and sets the bans and restrictions in the sphere of town-planning activity aimed at providing their safety, however never mentions objects of natural heritage though both of these terms are enshrined in one Convention. As categories "object of natural heritage" and OOPT do not coincide, it is possible to draw a conclusion that GRK Russian Federation does not contain the appropriate mechanism of guarantees of protection of natural heritage. The author also makes the offer to consider during town-planning activity not only a legal regime of valuable natural objects and complexes (OOPT), but also ecologically unsuccessful territories which typical example are zones of ecological catastrophe.
