Misappropriations: notions and characteristics

Misappropriations constitute the nucleus of all crimes against property in the present criminal legislationof the Russian Federation so there is a need to view their typical characteristics which are definedin Comments to Article 158 of the Criminal Code of the Russian Federation. It is stated in the articlethat to quality the crime it is important to ascertain the difference between property and the right to it,to establish the existence of somebodys material object, the properties of the object of stealing on thewhole, i.e. the characteristics of the property or the rights to it. The author gives a detailed examinationof characteristics of the target and actus reus of particular bodies of crimes and characteristics relationto the subject and mens rea of these bodies of crimes.
