Differentiation of a labor contract from related labor contracts in GreatBritain and the United States of America

Theproblems of differentiation of a labor contract from related civil-labor contracts are among the mostcomplicated and debatable in a labor law science. Complexity of labor relations and existence ofvarious forms of non-standard employment stipulate the need for search of new approaches to thecriteria of separation of labor contracts of different sectorial affiliation. The evolution of criteria ofdifferentiation of labor contracts from related civil-labor contracts in two countries based on an Anglo-Saxon legal system - Great Britain and the USA - is examined in the present article on the basis of theanalysis of current legislation, judicial precedents and legal literature.
