"Basic university": the place in the higher education system and problems of legal status

In article the problem of legal status and the place of the basic universities in the higher education system is considered. A legal assessment of a concept of "the basic university" of Russian law is given. Ambiguity and uncertainty of this term, lack of its formal fixing in the federal legislation is noted. The set derivative of this term - "basic higher education institution", "basic university of the region", "university center", "centers of innovative, technological and social development of regions", etc. is indicated existence that leads to washing out of maintenance of a concept and loss of quality of clarity and definiteness of the term. It is noted that the term "basic university" gradually leaves the use in legal language as owing to the last changes in the legislation other terms - "higher education institution as centers of space of innovations", "university center", "centers of innovative, technological and social development of regions" are used. The proximity of the term "basic university" with category "federal university" is stated. Taking into account relevant provisions of the federal legislation, between these terms there are practically no distinctions: at literal interpretation taking into account grammatical and logical receptions they have identical contents. In terms of the legal equipment such mixture is inadmissible especially as in the legislation the legal form, volumes and forms of financing and a condition of selection of higher education institutions of these categories get divorced. Following the results of the analysis of the regulations regulating the status of the basic universities signs of this category of the educational organizations are formulated. It is specified, that the main problem of the basic universities is the question of their legal status and legal destiny. It is obvious that fixing of legal position of the basic universities in the federal legislation arises. It is noted that a number of territorial subjects of the Russian Federation already went on the way of standard regulation of position of the basic universities. As a result of a research the conclusion is drawn that uncertainty of legal position of the basic universities raises doubts in maintaining such category of the Russian higher education institutions in the long term 2019-2025. Establishment of the status of the basic universities in the legislation on education and accurate cultivation of the basic and federal universities could become a logical conclusion of reform of the basic universities. The lack of clarity in the status of basic higher education institutions gives rise at regional bodies of the public power to uncertainty in the political relation to the basic universities and, including, involves the inert and passive relation to support of the basic universities. Besides, the refusal of the regional authorities of support of creation of the basic universities under fear of association and optimization of regional higher education institutions and also their transfer to regional financing is quite natural.
