Objects of natural heritage as a legal category

Effective environmental protection is impossible without a clear understanding of the object of such protection. This requires the formation of a conceptual (categorical) apparatus, which allows identifying precisely the object of legal protection and the list of measures necessary for its protection. Nowadays there is no clear legal regulation concerning the category "object of natural heritage", although its definition can be found in Article 1 of the Federal law "About environmental protection". Currently, both legislation and the scientific doctrine equate specially protected natural territories with the objects of natural heritage. The article substantiates the conclusion that natural heritage objects should exist both in specially protected areas and outside their borders, and this will require changes in environmental legislation for a clear regulation of their ecological and legal regime. It is necessary to solve a number of other issues related to the updating of the ratio of this legal category with related legal constructions (natural object, national resource etc.), the establishment of specific permissions, restrictions and prohibitions on implementation of the economic, recreational and other activities within the boundaries of the objects of natural heritage, solution of the issues about the owner of such territories and his powers, legal responsibility for the infringement on the objects of natural heritage etc. For the solution of these questions it is expedient to adopt a special law which could be called "About the objects of natural heritage in the Russian Federation".
