To the question of classification of the principles of family law

Russia is recording an increase in the number of laws adopted in all branches of law, including family law. However, there remains a problem with the orderliness of this normative material, its introduction into the system, the doctrinal perception of the trends and processes that occur while improving the quality of legislation. In this situation, there is a need to develop the existing methods of assessing the ongoing legal processes; the classification is one of them. As it has been rightly mentioned in the scientific literature, "without a proper, reasonable classification, it is difficult to ensure the social value of law or other statutory act as part of the legal regulatory system and the objectivity and sustainability of its existence." The article proves that the classification allows distributing the subjects under study into certain groups according to the analysis of their similarities and differences. Using the classification method in statutory acts enables us to regulate the content of legal enactments and the intentions of legislators, systematize them and make them more understandable; the creation of doctrinal classifications serves the purpose of learning the law and arguing proposals on ways and modes to improving the law and law enforcement practices. The classification is especially important when addressing the principles of law, that in a concentrated form contain the basic (basic) beginnings of the development of the relevant branch of law, including family law. The systematization of the principles of family law being carried out in the Russian scientific literature offers different lists of the principles and this can be explained by the shortcomings of legal technology in the formulation of Article 1 of the Family Code Russian Federation. Supporting such studies, the author proposes to classify the principles of family law into inter-branch and branch ones giving the reasons that at present there are no institutional principles in family law (separate Family-legal institutions). This classification does not claim to be complete and unambiguous and is an attempt to streamline the set of principles of family law to understand the dynamics of the branch better. The article pays special attention to the justification of the list of doctrinally deduced principles of family law, which can be used by legislators for supplementing Article 1 of the Family Code of the Russian Federation.
