On the current state of civilism

The article explains the meaning of the chosen approach to assessing the situation in the doctrine of private law. The term "state" here means the totality of the most significant characteristics of the subject under study. The role of the Russian Civil Code, which has become a point of reference for both achievements and mistakes, both in theory and in administration of law, is shown. The author emphasizes a special role of a powerful scientific base, the heritage of Soviet scientific schools and the classics of domestic civilization in the creation of the current legislation. Our Soviet teachers substantiated and developed the basic conceptual apparatus in a calm atmosphere of "developed socialism". The author expresses her concern about the signs of a certain underestimation of the doctrine of the Soviet period and the gradual loss of scientific continuity. The well-known thesis about the need to include the theory of law in the minimum of candidate exams is repeated. The reasons for the slow pace of private law theory are substantiated. It is proposed to return to strict planning of the subject of scientific research, starting from a primary level (departments, laboratories), with the consolidation of specific urgent topics, e.g. "Personality in private legal doctrine," "Legal status of subjects of private law" and others. Now it is really possible to try it on the basis of national universities. The article recommends the main areas of private legal research. First of all, we are talking about the improvement of the conceptual apparatus and about the interaction of branches. The question of the structure of private law is also a matter of principle. The author substantiates the thesis that housing law should be excluded from the elements of the private law. The article critically assesses the wording of certain rules of the Criminal Code of the Russian Federation, the Penal Code of the Russian Federation, containing private law terms ("someone else's property," "deals," "close persons" etc.). Among the current private law developments, the author recommends a block of rules from the mega branch "information law".
