Cooperation of public councils with assistants of principals of local offices of the Federal Penal Service over the protection of human rights

The author proves legal basis, necessity, directions and forms of cooperation of public councils with assistants of principals of local offices of the Federal Penal Service over the protection of human rights. Current legislation does not provide a legal basis of cooperation of public councils with assistants of principals of local offices over the protection of human rights. However, they have common purposes. Civil engagement in the protection of human rights is impossible without control over the necessary conditions for observance of rights of suspected and accused persons. The author proposes to extend powers of public councils by means of participation of public council members in the work of assistants of principals of local offices of the Federal Penal Service over the protection of human rights. It is proposed to formalize three main directions of cooperation of public councils and assistants over the human rights. Firstly, it is participation in public deliberations of legal rules and other documents developed by the Federal Penal Service of the Russian Federation. Secondly, it is participation in elaboration and realization of programs over current problems of the activity of institutes and public councils the Federal Penal Service in improvement of conditions of serving punishment by convicts, confinement of suspected and accused persons. Thirdly, it is execution of public control for observation of rights and legal interests of the convicted, of persons in custody and of officials of the penal service in penal institutions. The author suggests to confirm rights and responsibilities of the considered persons over the following directions: joint consideration of applications, contained information on violation of human rights in the penal system; carrying out consultations of the convicted, of persons in custody, of officials of the penal service and of other persons on personal matters; carrying out visits to penal institutions to control the observance of rights and legal interests of the convicted, of persons in custody, of officials of the penal service; participation in the supervision of institutions subordinate to the local office of the Federal Penal Service of the Russian Federation; participation in the training of officials of the local office of the Federal Penal service of the Russian Federation; making suggestions to encourage the officials of the penal service.
