Some aspects of legal labor regulation in organizations engaged in supervising services for the oil and gas industry
Development of specialized services in the oil and gas industry, introduction of effective technologies and optimization of industrial project management update the problem of supervising as a form of entrepreneurial activity. The problems of organization and management of work of service companies' employees engaged in supervising activities in the oil and gas industry are discussed in the article. The reasons causing the increase of labor costs of employees engaged in supervising activities are substantiated. The influence of the new professional standard of a supervisor on the maintenance of labor relations in the part of medical examinations and mandatory training is discussed. Specific methods of supervisor's labor process organization were examined. Some arguments explaining the inability to use outsourcing as a practice for temporary representation of their staff by service companies today are mentioned. Several possible ways of supervisor's work organization in the areas remote from the employer's location are suggested. Remote or roving methods of work are considered the most appropriate for the oil and gas industry. Guarantees and compensations related to the traveling nature of the work and actual work in the regions of Far North provided in the current labor law are analyzed. In conclusion, the findings on the legal ways possible for the organization of supervisor's labor process in service companies are summarized and the main directions for improvement of labor legislation in this field are determined and considered. The materials that allowed generalizing the problems of legal regulation of employment in companies providing supervising services in the oil and gas sector were obtained by the author as a result of providing legal advice to similar companies and performing some research projects on relevant topics. The author concludes that the labor legislation has a number of gaps and contradictions that create conditions for violations of the rights of employees of service companies providing supervising services. This is lack of legal regulation of labor activities with a traveling nature, the absence of rules on guarantees and compensations in connection with the work with a traveling nature in the Far North and similar regions, unsystematic use of labor legislation "compensation" category, lack of resolution of atypical labor relations in cases where the employee performs work outside the direct control and supervision of the employer. A further improvement of the legislation in the following area would help to streamline labor relations in companies providing supervising services, and enhance the level of legal protection of labor rights and interests of workers and employers.
