On the system of proceeding stages in cases of the federal state fire supervision

This article discusses the system and the content of the stages of proceedings in cases of the federal state fire supervision. This issue was not subject to an independent investigation, which to some extent explains the low level of its development. The aim of the study is to determine what the system of the stages of proceedings on the federal state fire supervision mean, to characterize each of its components. Various general scientific techniques and methods of logical knowledge are used: analysis and synthesis, abstraction, modeling, system-structural, functional and formal-logical approaches. Specific scientific methods are formal legal and comparative legal methods. In the article the need to consider the question is explained in connection with the fact that the administrative supervision proceedings are non-uniform and, therefore, the system of proceeding stages in the federal state fire supervision will have its own features. The author summarizes the proceedings on the federal state fire supervision, the basic approaches to the definition of its stages, analyzes and determines their features and reasons for their classification, characterizes the content of each of the stages. In this work proceedings on the federal state fire supervision are understood as regulated administrative and procedural rules of activity of the competent entities in relation to specific legal persons and individual entrepreneurs engaged in fire control, in strict compliance with the special legal procedures, and directed on the practical implementation of jurisdictional measures in cases of administrative violations in the field of fire safety; a stage is a relatively isolated part of administrative proceedings consisting of activities of the participants of the process united by immediate goals and objectives of the proceedings, characterized by a specific procedural purpose, regulated in detail by administrative and procedural rules, completed with the adoption of interim or final decisions and ensuring a logical sequence and purpose of proceedings. As a result of the research the author comes to a conclusion that the system of proceeding stages in this sphere must be differentiated depending on the mode of supervisory regime. In relation to the federal state fire supervision there are two kinds of modes: continuous and periodic with scheduled and unscheduled inspections. In general terms, this system can be represented as follows: check organization; check implementation; check results registration and taking appropriate action; appeal (an optional stage). The practical significance of the proposed system of stages of proceedings on the federal state fire supervision, according to the author, is that this approach covers almost all important issues related to the technology of administrative and supervisory proceedings.
