Revisiting Criminalistic Stages of the Pre-Trial Procedure in Criminal Cases on Violations of Traffic Rules by Persons Subjected to Administrative Punishment
The aim of the article is the development of the authors' conception of criminalistic stages of pre-trial procedure in violations of traffic rules by persons subjected to administrative punishment. The authors use a systematic and structural, formal and legal, comparative and legal, sociological methods. Researchers in criminalistics propose to divide the stage of preliminary investigation into stages. Identification of preliminary investigation stages, which have methodological significance, should be carried out according to the criminal procedural requirements, including the stages of criminal proceedings. At the present stage of the development of crimi-nalistics, it has become relevant to consider not only the periodization of the investigation of a crime, but also the entire pre-trial procedure. The authors determine the structure of the criminalistic stages of the pre-trial procedure in violations of traffic rules by persons subjected to administrative punishment: it has two stages and two sub-stages. The initial stage of the pre-trial procedure includes the consideration of a crime report and an appropriate decision on it by the inquiry officer after carrying out urgent investigative and other legal procedural actions. The second stage of the pre-trial procedure consists of two sub-stages. The initial sub-stage begins after the initiation of a criminal case and finishes with the interrogation of the suspect. This sub-stage is characterized by dynamism in conducting investigative and other legal procedural actions. The second sub-stage begins after the interrogation of the suspect. Depending on the suspect's position, more systematic course of work on the criminal case is done. The sub-stage finishes with the decision on a conclusion of investigation. The authors conclude that the criminalistic stages of the pre-trial procedure in violations of traffic rules by persons subjected to administrative punishment aim to arrange the activity of subjects of investigation. Criminalistic stages allow them to quickly understand the array of investigative actions, determine the correct sequence of their conduct in a certain criminalistic (investigative) situation in criminal proceedings.
