International Guarantees of the Rights of the Most Vulnerable Groups of Population in Unrecognised States

The topic of the study is the international aspects of ensuring the rights of the most vulnerable groups in unrecognised states. The following tasks were solved in the article: theoretical issues of humanitarian interventions in unrecognised states and the problems of the appropriateness of forced military actions undertaken by states or groups of states were examined; various recognition theories were investigated; guarantees of the rights of the most vulnerable groups in unrecognised states, which have a profound effect on the development of international law, were studied. The methodological basis of the article is the scientific methods of cognition. A significant role in the preparation of the article was played by the dialectical method, the historical method, the deduction method, and the induction method. To solve the tasks, the following specific scientific methods were used: systemic, logical, chronological, comparative historical, comparative legal, formal legal. The article concludes that, within the framework of traditional international law, only states and, in some cases, international organisations could exercise their rights at the international level. Currently, the most vulnerable groups of the population have the right to appeal to international instances and courts in violation of their rights. Moreover, the most vulnerable groups of the population should have guarantees for the use of the provisions fixed in the constitutions and laws of their countries of residence. In accordance with the law, civilians are protected during armed conflicts. The basic theoretical issues of humanitarian operations are considered. At the same time, two theories have historically developed: declarative and constitutive. The declarative theory proceeds from the fact that unrecognised states are subjects of international law from the moment they emerge. Recognition does not endow states with international legal personality, but merely declares it. In this regard, the article examines the rights of the most vulnerable groups in the world, which have a profound impact on the development of international law. It is concluded that it is advisable to adopt the United Nations Convention on the Guarantees of the Rights of the Most Vulnerable Groups in Unrecognised States, which would provide basic guarantees for the rights of the most vulnerable groups in unrecognised states.
