Freedom of peaceful assembly and the idea of people's assemblies as elements of communicative constitutionalism and direct democracy
The article identifies the public-legal nature of freedom of peaceful assembly and people's assemblies, and reveals the nature of communication rights and freedoms of man and citizen, the role of citizens' assemblies in the implementation of democracy and constituent power in the context of international scientific discussion and comparative experience of constitutional changes. The authors pay special attention to the analysis of the goals, content and functions of the constitutional freedom of peaceful assembly, which is the most important basic element of communicative constitutionalism and direct democracy. The article also analyzes the concepts of democracy of assemblies and citizens' assemblies in the context of public participation and constitutional changes, notes the special role and constitutional value of freedom of peaceful assembly in a democratic and legal state. Freedom of peaceful assembly in modern constitutional thought is closely related to the forms of political participation and the implementation of democracy, and has substantive components interrelated with the idea of people's, or citizens', assemblies. People's assemblies are assemblies of citizens that are held to implement various forms of democracy, primarily constituent powers, if they are related to constitutional amendments and revision of the constitution. To the same extent, this is a form of citizen participation in the discussion and decision-making not only on constitutional issues, but also on other significant issues in the public sphere. One of the understandings of people's assemblies includes citizen participation in peaceful assembly that can be used to discuss public issues and form the agenda of desired or proposed constitutional changes. The article used epistemological and gnoseological approaches, methods of dialectical materialism, critical research in the field of law, formal-legal, specific-historical, comparative legal and complex analysis. The authors conclude that citizens' assemblies as a public-legal institution combine old and new ideas about citizens' participation in the implementation of various forms of democracy, in the implementation of the generative potential of the constituent power. The institution of people's assemblies (or citizens' assemblies) acquires the features of a new public-law formation that creates a deliberative environment and actively participates in the formation of the institutional basis of deliberative constitutionalism. The right of citizens to participate in public mass events, including peaceful assembly, on the one hand, and their right to participate in constitutional changes and in discussing their desirability in citizens' assemblies and other mini-societies of a collective nature are the most important communication rights in the public sphere.
