Tactical methods of assigning investigative actions
The article reveals a set of problems associated with tactical and forensic optimization of assigning investigative actions. The range of problems affects the methodological, historical, forensic and psychological aspects. The subject of the study was a set of tactical and forensic methods for organizing the conduct of an examination and research of a specialist. The following general scientific methods were used in the study: analysis, synthesis, system-structural. The following specific scientific methods were used in the study: experiment, included observation, modeling, expert assessment. The article received a number of the following conclusions. Today, forensic tactics are clearly lacking in tactical recommendations in the field of investigative actions. There is a distinction between scientific tactical methods of investigative actions and technical recommendations based on everyday logic. This division is based on the answer to the question "how to do it?" in tactical methods, or the answer to the question "what to do?" in recommendations based on everyday logic. Formulating questions for an expert and a specialist is not a tactical method, since the most effective way to formulate questions for an expert is to use special reference literature. A recommendation on the advisability of making a decision on the sufficiency of the volume of objects sent for examination is not a tactical method. The concept of sufficiency is difficult to formalize and, as a result, does not contribute to understanding the necessary volume of materials presented. In the group of tactical methods in the field of assigning examinations, the most promising is the development of tactical methods for choosing a person with special knowledge. We find it difficult to name the states that optimize the professional potential of a person as clearly as the circumstances that destabilize it. All the recommendations given in the article may not be relevant in a situation where the investigator does not have the opportunity to choose the person conducting the investigative actions. However, they remain relevant in any case when assessing the results of the investigative action. The said relevance stems from the context of the individual characteristics of the person with special knowledge. In general, the result of the study was a set of tactical recommendations aimed at optimizing the appointment of investigative actions. The author declares no conflicts of interests.
