Acquisition of the proprietary right by the contract on the immovable property
In the article the new legislation of the Russian Federation determining the moment of origin the acguirers proprietary right by the contract on the immovable properly is analysed. Analysis of the appropriate norms of Civil code and other laws leads to the conclusion that the proprietary right on the immovable things arises from the moment of state registration of the proprietary right transition independently of sellers fulfilment his duty to hand over the property to the acguirer.In a case of an enteipise selling proprietary right passes to buyer and is subject to the state registration direct after the enterprise transition to the buyer. It is proposed to spead this rule on cases of alienation of other kinds of real estate.
