Application of the criminal procedure rules of law by the judge (court)

The article isprolongation in research of the writer of problems of legal regulation of criminal procedure relations. The theory of application of therules of law of the Criminal Procedure Code of the Russian Federation are considered in activity of the judges and courts. The generaltheoretic rules about application of the law interpret to activity of the concrete subjects of the criminal trial - judges. The application ofthe rule of law of the Criminal Procedure Code by the judges is analyzed in different aspects: as the responsibility by the judge onapplication of the criminal and criminal procedure rules of law in the definite order, as realization by the judges of the provisions of theconcrete rules of law of the Criminal Code and of the Criminal Procedure Code and as a condition and basis of realization of the rightsby other participants of the criminal trial.
