The definition of the freedom of behaviour (discretion) of the legal defence counsel and the accused as the participants of the criminal procedure of the RF
The author investigates the problems of the freedom of behavior (discretion) of the criminal procedure participants on the defense sideunder the Criminal Procedure Code of the RF. The definition of the freedom of behavior (discretion) of a suspect and an accused as acriminal procedure participant on the defense side is made in the article. The article points out the dependence of the freedom of behavior(discretion) on the criminal procedure participants' activity and their legal responsibility for such behavior. The criteria forlimitation of the criminal prosecution and adjudication authorities are set out. The concrete proposals on the amendments to the CriminalProcedure Code of the RF are made.
