Aggravating circumstances of mens rea of corpus delicti in foreign criminal law
While defining the general basis of awarding a punishment, formulating the qualified corpus delicti in the articles of the Special part of the Criminal Code of the Russian Federation, the legislator uses the institute of aggravating circumstances which strengthen the criminal responsibility and punishment. Thus, the role of the circumstances aggravating the punishment according to the Criminal Law is obvious - to reinforce the penalty of the guilty. A complex of commands defining the stimulating motives and the aims of the committed crimes takes a special place in the system of the circumstances aggravating the punishment.
