On Safety of Criminal Proceedings Participants Registered by the Penal Enforcement Inspectorate

The penal enforcement inspectorate is to strengthen confidentiality measures related to a person under state protection on the basis of a reasoned decision or other official information document about the application of such measures from the security body. When applying security measures to a registered person, the penal enforcement inspectorate limits the circle of persons who may be exposed to a registered person, with its functions performed by specially instructed employees. The preventive measures as well as punishments and criminal justice response executed by the penal enforcement inspectorate are implemented in their usual course. If the protected person is moved to a safe location, the penalties in the form of corrective and compulsory labor are suspended, and the responsibility for the person to whom the preventive measure is applied passes to the body that implements the security measures. The delivery of a person confined to house arrest to the court or for investigation procedures also lies within this body’s scope of responsibilities. The penal enforcement inspectorate is to inform the security body of interest to the protected person by third parties. In exceptional cases related to proceedings in another criminal, civil or administrative case, the information about the protected person may be submitted to the preliminary investigation bodies, prosecutor’s office or court upon a written request of the prosecutor or court (judge) with the permission of the body that makes the decision to implement the state protection.
