Criminal justice or prosecutor's supervision?
Implementation of the juvenile justice system is the abolition of the existing system of prosecutor's supervision, as well as a radical change in the existing judicial procedures for resolving cases involving minors. It seems that the current law enforcement practices and current legislation are hardly ready for such innovations. Establishement of any specialized justice agencies contradicts the existing national tradition of organisation and activities of the judicial system based on the principle of the universality of the court which considers and solves cases regardless of its legal or social nature. In this respect, Russia has no tradition of specialized justice. Moreover, any proposals for the establishment of such bodies are often regarded as hidden attempts to diminish the authority and powers of the existing judiciary. Therefore, politically proposals to establish juvenile justice agencies are very complex in terms of implementation. Today, there are no explicit regulatory objective prerequisites for any new justice or control bodies. Certain federal laws have independent sections on proceedings in cases with juveniles, which emphasises the essential features of procedural and other activities. Yet, this fact cannot be a prerequisite for the establishment of specialized forms. Issues affecting the interests of minors are heterogeneous and insufficient to establish a separate specialized body to consider these cases. Changing the existing jurisdiction will corrupt the nature of these legal institutions, some state bodies will lose their powers determined by the current system of checks and balances, law enforcement will become more complicated. In this regard, the procedural and other legislation does not seem to form any preconditions for the establishment of specialized bodies of juvenile justice.
