Activities of penal inspectorates to prevent recidivism by persons sentenced to penalties or other measures of criminal liability not connected with isolation from society

In sentencing or other measures of criminal liability not connected with isolation from society, the convict shall bear penal responsibilities and limitations related to the implementation of control over the execution of the court sentence by the penal inspectorate, which includes prevention work. In addition, both the control over execution of the court sentence and prevention activities carried out with convicts by penal inspectorates are implemented in accordance with the requirements of the Criminal, Criminal Executive and Criminal Procedure Codes of the Russian Federation and agency regulations (Order of the Russian Ministry of Justice of May 20, 2009 no. 142, Order of the Russian Ministry of Justice of October 11, 2010 no. 258). It should be emphasized that the preventive work with persons sentenced to penalties and other measures of criminal liability not connected with isolation from society is organized only individually. A special purpose of recidivism prevention by penal inspectorates is elimination, reduction or neutralization of the convict's anti-social personality traits. Moreover, with the enforcement of sentences and measures of criminal liability not connected with isolation of the convict from society, in the course of controlling his/her behavior, penal inspectorates indirectly influence the conditions under which the negative traits of the convicted person may show. At the same time, speaking about the anti-social personality traits of the convicted person, it should be kept in mind that even when sentencing him/her, the court takes into account such traits and, in fact, its decision determines possible preventive measures. Such measures are individual preventive conversations with the convict and monitoring of the enforcement of the court judgment. The content of specific individual prevention of recidivism is different depending on the court sentence or other measures of criminal liability not connected with isolation of the convict from society.
