On the state of terrorist and extremist crime in the Republic of Kazakhstan
The article examines the state of terrorist and extremist crime in the Republic of Kazakhstan on the basis of empirical materials of the prosecutor's, investigative and judicial practice. There is a tendency to bring to justice persons who did not commit crimes related to extremism and terrorism, but who previously committed common crimes. This trend requires a review of the practice of these persons' serving sentences in prison. When serving a sentence together with individuals who commit common and other crimes, the risk of expanding the circle of persons who can potentially become involved in the extremist environment increases. This can cause the loss of control over them when they are released. In turn, the serving of sentences by persons convicted of extremist and terrorist crimes in a specialized facility will provide an opportunity not only to monitor these persons both during the serving of the sentence and during release, but to take point and comprehensive measures aimed at their re-education, change of their psychological attitude, including with the involvement of the traditional clergy. Thus, without resolving the political, economic and social problems that led to the emergence of terrorism and religious extremism, the struggle against them will never be fully successful. The state policy and legislation in the field of countering extremism and terrorism must be formed symmetrically with the increased degree of the public danger of extremism and terrorism, the forecast of the development of illegal activities of nationalistic, religious, ethnic and other organizations, and thus acquire a systemic character.
