Features of the object and target of crimes in the sphere of cryptocurrency turnover

Cryptocurrency public relations as an object of criminal law protection and the target of legal regulation should be considered only after legislative consolidation of the corresponding concepts, since nowadays cryptocurrency relations all over the world, including Russia, exist and develop on their own, without due attention from the state. Cryptocurrency must be recognized as other property (digital property) under Article 128 of the Civil Code of the Russian Federation. Thus, by defining the legal status of cryptocurrencies as property, one can consider public relations, developing in the sphere of its turnover, as a new object of criminal law protection. It seems that the basic principle of establishing the object of cryptocurrency relations is the understanding of the fact that a cryptocurrency has a value, so any criminal manifestations in this regard may entail damage to both individuals and society and the state as a whole. Of great importance for determining the signs of cryptocurrency relations as an object is to determine the properties of the target of a crime in the sphere of cryptocurrency turnover. The targets of such crimes have certain specificity, since they have a price and consumer demand, while the volume of cryptocurrency turnover tends to increase, and, in addition, cryptocurrency as an object is intangible, as it is a digital code. The nature of the targets of crimes under consideration varies from encroachments on property to encroachments on public safety, and, up to now, due to the high latency of crypto-crime, has not been fully studied. There is a need to establish a general rule on crimes committed in the field of cryptocurrency, based on the abstract way of presenting the disposition.
