Legally relevant personal characteristics of offenders in the application of penitentiary probation measures
The implementation of executive, penitentiary, and post-penitentiary probation measures requires a thorough examination of the circumstances that form the demographic background, psychological profile, and social roles of a convicted individual. Identifying the factors relevant for selecting effective probation measures can only be achieved through a unified and scientifically grounded approach to defining the offender's personality and the scope of its assessment for probation purposes. Different combinations of data reflecting an individual's social-typological, moral-psychological, and socio-role characteristics determine the appropriateness of applying specific penitentiary probation measures. The author analyzes various academic approaches to defining the concept of an offender's personality, its key characteristics, and the specific circumstances that constitute these traits. These factors should guide practitioners in implementing legally established penitentiary probation measures. The examined personal circumstances of convicts eligible for penitentiary probation are crucial for selecting (or assisting the convict in selecting) probationary interventions that are most likely to facilitate successful reintegration.
