Specifics of the legal status elements for convicts sentenced to compulsory labor
This study presents a comparative legal analysis of compulsory labor convicts' legal status, categorizing its components into three distinct tiers: 1.1 - elements common to all convicted persons; 2.1 - elements shared with noncustodial penalties; 2.2 - elements shared with imprisonment; 3.1 -unique rights, legitimate interests, and obligations distinguishing this penalty type. The analysis of Section II of the Internal Regulations of Correctional Centers "Basic Rights and Duties of Compulsory Labor Convicts" reveals that only 7 of 55 established legal status elements of compulsory labor convicts (12.7%) are truly unique to this penalty; 5 elements (9.1%) directly replicate norms from the Penal Execution Code of Russia; the remaining 43 elements of the legal status elements of compulsory labor convicts (78.2%) mirror provisions from the Internal Regulations of Prisons with minor modifications. The paper concludes with proposed measures to address regulatory gaps in this sphere. The author declares no conflicts of interests.
