Consular protection of the Mexican migrants' rights abroad

This article is dedicated to the problem of protection of the Mexican migrants' rights abroad. The author studies the main problems and violations of rights faced by migrants that came to the USA in a search of a better life. The problem of the violation of the inalienable human rights enshrined in the Universal Declaration of Human Rights is examined. The bright example of such violations one can see in the treatment of migrants who are illegally in the United States. According to the latest surveys the number of illegal immigrants is approximately 6.8 million in the US, it is almost 55% of the total number of Mexican migrants. This article describes the types of consular assistance that Mexican Consulate provides migrants, regardless of their position whether it is legal or unresolved immigration status in the USA, because one of the most important aspects and principles of foreign policy of the Mexico Government is respect and protection of the migrants' fundamental rights. There are certain procedures that protect the migrants' rights during and after detention by the US authorities. The problem is that most migrants don't know their legal rights and as a result are discriminated by the authorities of the United States. The most repeated cases of violations of the migrants' rights during their detention are unsanitary conditions, lack of opportunity to file a complaint, the inability to communicate with the Consulate and the lack of personal belongings return after deportation. To solve this problem, Consulate together with the Government of Mexico work active and create special bodies, such as the Beta Group to protect the migrants' rights. The duties of these groups are the following: humanitarian, search-and-rescue and legal assistance to Mexican migrants. However, a huge flow of migrants from Mexico to the United States leads to increased anti-immigrant sentiment in many states. This is most clearly shown in the policy of Alabama, Arizona, Utah and South Carolina. In this regard, laws against illegal immigrants, citizens of Latin America, especially Mexicans are created in those states. These laws violate human rights. It is concluded that, in spite of all the existing state bodies, as well as legal documents, human rights continue to be violated as shown by the example of illegal migrants. To avoid this, there must be mechanisms, programs and humanitarian assistance to migrants on both sides of the border. Appropriate sanctions against violations of the migrants' rights should be applied. It is necessary to change the attitude to the adopted laws, and to reconsider the immigration policy of the USA and Mexico.
