Defeasibility and legal language: H.L.A. Hart in defense
The article analyzes an idea of defeasibility in a context of the legal language, which is represented in H.L.A. Hart's article "The Ascription of Responsibility and Rights". K. Cherry and M. Bayles's critical conceptions against defeasibility are considered. It is proved that the explication of idea of defeasibility in H.L.A. Hart's interpretation is possible in legal language. Two types of defeasi-bility - an ontological and conceptual defeasibility are offered.
