Power, law and justice in the contemporary social and philosophical theory: justness as the foundation of European modernity
The article presents the contemporary socio-philosophical edition of "justice" as the reception of Aristotelian ideas of the purposeful and equal distribution. Ways of a tematization of the "justice" in the social theory and political philosophy are analyzed. Identified three ways in consideration of a justice in the social theory and political philosophy: justice as growth of a welfare, justice as the value of freedom and autonomy and justice as "virtue" and the idea of "the good life". The methodological bases of the analysis and representation of this phenomenon are noted as continuations of logic of ancient topics of "justice". The base for the modern social and philosophical theory is the idea of Aristotle on justice as the ultimate goal of the state and social in general. The political appears as the natural horizon of any self-expression and the most important aspect of a fair situation. The contemporary philosophical discussion on problems of the right shows not eliminability of the horizons "justice" from the scope of the theoretical. According to the authors, the discourse of justice serves as an area of categorization of duties and obligations, and the sphere of right applications.
