Down to Earth: From Begriffsjurisprudenz to Analytical Jurisprudence

This article is a commentary, or rather an introduction to the problems considered by Herbert Hart in the paper “Jhering's Heaven of Concepts and Modern Analytical Jurisprudence” that he presented in 1969 at a symposium in Gottingen in honor of the 150th anniversary of the birth of Rudolf von Jhering. The authors try to clarify the genuine subject of his discussion, as well as why Hart came to the conclusions and ideas presented in it. A Russian translation of Hart's paper is published in this issue.
