A judicial identity: the Canadian Metis before the courts

Section 35 of the 1982 Constitution Act of Canada recognizes First Nations, Metis and Inuit as Aboriginal peoples with Aboriginal rights. The history of the Metis of the Red River in Manitoba is best known because of their place in the archives and the two resistances they led in the colonization of the Northwest. But it is only since the Supreme Court of Canada Powley decision in 2003 that experts have seriously considered the history and culture of Metis communities in other provinces and territories across the country. These marginalized communities are not recognized by the federal and provincial governments or by Western Metis associations and must fight for recognition of their identity. This article presents the struggle of these communities in the face of the symbolic violence of which they are victims.
