Anthropologization of Law (On the Example of Laws on Small Indigenous Peoples of the North)

The purpose of the article is to examine the processes of the gradual emergence of pluralistic laws on indigenous peoples of the Russian North and the complexity of their reading and application. Federal and regional laws concerning nomadic peoples are considered, as well as possible incorporation of their customary law into the legal system of the state. The article is based on field research of the lawmaking process in Moscow and Yakutsk, as well as on the study of the everyday life of indigenous peoples in different regions of the North and the Arctic. The customs and traditions of indigenous peoples determine the rules of traditional nature management, regulation of social relations in the everyday life of families, communities and wider communities of indigenous peoples of the North. The article emphasizes the importance of taking them into account for the development of public policy in relation to these peoples in modern conditions, noting the peculiarities of legal consciousness of nomads. The methodological approach to the anthropological critique of legislation is planned legal pluralism. The proposed framework allows to show the importance of regulating everyday life on the basis of local knowledge and the complexity of law enforcement of pluralistic laws.
