Peculiarities of fraud in labour relations

The practice of applying the law is faced with such types of embezzlement as fraud in labour relations, masked by a fictitious labour contract. A typical scheme of fraud in labour relations is when the employment contract is concluded without performance of work, or when the work is performed not by a person assigned for work. Several schemes of embezzlement are possible. It should be noted that the Russian criminal legislation does not qualify fraud in the labour relations. This act is qualified as a simple fraud, or a disciplinary offense, or as a civil tort, while this act must definitely be criminalised. As a result, there exists no uniform law enforcement practice.
