On some problems of remuneration of prosecutors in connection with their official powers

In real life, it is difficult to exclude cases of gifts presented to prosecutorial officer in connection with their official activities outside of protocol activities. Such situations may arise regardless of the will and behaviour of the prosecutorial officers (for example, leaving valuables as gifts in the prosecutor's office without the knowledge of the officer). Is it possible to use the mechanism proposed by the Regulations to convert such gifts to special funds? The literal interpretation of the Provisions does not allow it. However, despite this, a similar mechanism must still exist: a bona fide prosecutor must have a legitimate way out of the conflict situation that has arisen in connection with presenting a gift against their will and desire. Therefore, the author considers it possible to supplement the specific directives of the Prosecutor General of the Russian Federation with provisions regulating the transfer of gifts brought to prosecutorial officers in connection with their official duties outside protocol events to special funds. At It is necessary to emphasise that it is proposed not to legalise gifts or non-commissioned remuneration for their professional activities, but to create an additional guarantee of the prosecution service stability and compliance with prohibitions and restrictions associated with it. The receipt of remuneration by prosecutors in connection with the performance of their official duties outside protocol activities in all other cases must serve as an indisputable basis for conducting an internal audit and adoption of appropriate response measures based on its results.
