Legal support of initial measures of search for persons sentenced to criminal punishment in the form of deprivation of the right to occupy certain positions or engage in certain activities

The article analyses the legal problems of carrying out initial measures to search for persons sentenced to criminal punishment in the form of deprivation of the right to occupy certain positions or engage in certain activities and proposes their solution. The current penal legislation provides for the penal inspectorate's obligation to carry out initial search activities in respect of specific categories of convicts registered with the inspectorate. With regard to those sentenced to deprivation of the right to occupy certain positions or engage in certain activities, such an obligation is not provided for by law. The aim of this article is to substantiate the need to consolidate in the penal legislation the obligation to conduct initial search activities to establish the whereabouts of persons sentenced to deprivation of the right to occupy certain positions or engage in certain activities, as well as to put them on the wanted list. The problems of establishing the whereabouts of persons sentenced to deprivation of the right to occupy certain positions or engage in certain activities, including the CIS member states' citizens who have fled from the control of penal inspectorates, are considered. Proposals are formulated to improve the legal and organizational framework for the conduct of initial search activities by penal inspectorates in relation to such persons. The implementation of the proposals will improve the conceptual framework, legal regulation and practice of conducting initial measures to search for persons sentenced to deprivation of the right to occupy certain positions or engage in certain activities.
